Recently, there are allegations that the design of the earplugs was defective because it failed to properly safeguard the ear during use. US Government’s lawsuit over 3M Dual Sided Combat Arms Ear Plugs
In 2003, the Federal government entered into a contract with Aero Technologies to supply Dual Sided Combat Arms earplugs to active duty military in all branches of service. Aero Technologies certified their Combat Arms Earplugs would work as designed to protect active duty military against hearing loss. In a lawsuit filed by the US Justice Department, Aero Technologies and the 3M Corporation were alleged to have had knowledge of the design defect in the Combat Arms Earplugs and failed to notify the government of the defect. The Justice Department’s claim was brought against the 3M Corporation under The Federal False Claims Act that allows for both civil and criminal penalties for falsely billing the government, over representing the amount of a delivered product, or understating an obligation to the government. In July 2018, the 3M Corporation agreed to pay out $9.1 million to the US government to settle allegations that they had knowingly sold defective Dual Sided Combat Arms to the US military.
