What Do Criminal Lawyers Do?
Criminal lawyers represent individuals who are accused of committing criminal offenses against people and/or property within a court of law. Criminal lawyers utilize their experience at dealing with various judges, prosecutors and court staff, together with their knowledge of the rules of the court and pre-existing case law, in an effort to refute the legitimacy of the allegations against their clients.
These efforts are undertaken in the pre-trial or trial phases of the case, often attempting to show the judge(s) of fact and/or law that the prosecution has failed to meet its burden of proof concerning the charges against a Defendant. The primary function of the responsibilities of Criminal Defense Lawyers as defense counsel is to enact checks and balances on law enforcement by making sure that their clients’ Constitutional Rights were not violated during the course of their encounter with the police.
The primary function of the responsibilities of Criminal Defense Lawyers as officers of the Court is to enact checks and balances on the Courts themselves as well as on the prosecution by making sure that their Clients’ Constitutional Rights to Due Process are not violated during the course of court proceedings.
