On December 4, 2017, Plaintiff, a 44 year old male, was traveling westbound on Raymond Road in South Brunswick, New Jersey, when Defendant failed to stop for a red traffic signal and struck Plaintiff’s vehicle. Plaintiff remained for 2 days in the hospital having been diagnosed with a rib fracture, renal artery hemorrhage; traumatic injury to right lower pole accessory renal artery; and an acromioclavicular tear.
Plaintiff’s counsel, Michelle M. Tullio, Esq. of the Garces, Grabler & LeBrocq, P.C. law firm in Perth Amboy, NJ alleged that as a result of this incident, Plaintiff sustained injuries to his lower and upper back, Carpal Tunnel Syndrome, displaced right posterior 12th rib fracture, traumatic injury to a right lower pole accessory renal artery, left shoulder, left elbow and left bicep.
Subsequently, Plaintiff underwent surgery to the lumbar spine and another surgery to his cervical spine. Additionally Plaintiff underwent invasive treatments for pain management, including injections and radiofrequency ablation. Plaintiff also underwent chiropractic treatment and pain management treatment, but gained no relief. Due to his injuries, the Plaintiff was out of work on disability for more than six months and his physical activities were extremely limited. Other than Plaintiff’s cervical and lumbar injuries, all of his other injuries resolved without the need for further medical treatment.

Before an Answer was filed by the Defendant, the Defendant’s insurance carrier called to settle the case before continuing with litigation.
