Appellate Law

Appellate Division or 3RD Circuit Court

The Appellate Division of the New Jersey Superior Court is the Court to which all appeals from convictions are argued.

The Federal Third Circuit Court of Appeals in Philadelphia, PA is the Court to which those who are convicted in New Jersey Federal Criminal Courts (Newark, Trenton, Camden) can appeal.

A criminal defendant is entitled to only one direct appeal after a conviction. This means you get only one bite at the apple. Consequently, you had better make the most of it.

In a criminal appeal, criminal lawyers seek a reversal of the conviction based upon legal errors made during the trial and during any pretrial motions or hearings. Reversing a conviction and winning a new trial are not so easy to achieve. The legal standards governing the review of trial errors generally favors the decisions and rulings made before and during the trial.

In addition, most Prosecutors’ Offices employ experienced appellate attorneys who specialize in writing criminal appellate briefs aimed at upholding convictions and sentences. Effective criminal appellate advocacy requires extensive knowledge of law, commitment to detail, legal writing ability, and dogged determination.
